- Title
Rosner/Winheller: Mediation und Verhandlungsführung.
- Authors
Wendenburg, Felix
- Abstract
The article covers various topics, including the decision of the Federal Court of Justice (BGH) regarding the admission of a mediator as an in-house lawyer. The Federal Bar Association (BRAK) comments on the adaptation of out-of-court dispute resolution to digital markets and calls for clear quality criteria and independent examinations. Furthermore, BRAK supports the possibility of out-of-court dispute resolution with companies outside the EU. In a book review, the work "Mediation and Negotiation" by Rosner and Winheller is described as a successful blend of theory and practice. Another part of the article describes a court case in which a man was bitten by a cat and the man's liability insurance company refused to pay compensation. After lengthy negotiations, the judgment dismissing the claim was finally overturned and the matter was referred back for a new hearing on the amount of damages.
