- Abstract
The article examines the current state of alternative dispute resolution in the USA. It discusses the use and evaluation of court-adjacent online dispute resolution (ODR) as well as the use of "special masters" in state courts. It emphasizes that alternative dispute resolution is institutionalized in the USA, but there has been no dramatic expansion in the last ten years. Influential organizations such as the National Center for State Courts (NCSC) and the Pew Charitable Trusts (Pew) have encouraged state courts to implement ODR to improve access to justice. Positive results and challenges in the use of ODR are highlighted. The Pew Charitable Trusts and the NCSC have developed models for evaluating ODR programs and recommend the collection and analysis of data. The role of special referees in state and federal courts is also discussed, emphasizing that their functions can be flexible. The American Bar Association has adopted guidelines for the appointment and use of special referees.
