- Abstract
Education as a human right enables the realization of other rights and sustainable development. As a fundamental and social right, it generates personal autonomy and progress in the social, economic and democratic spheres. That is the theme of this research, which is linked to the project "Characteristics of the access to the right to education of nationals and migrants in first and second grade of primary school in the Official Educational Institutions of Malambo in 2022". We took as a starting point the international human rights law and the social reality to propose the objective of describing the conditions provided by the municipality of Malambo to guarantee the right of access to education for over age nationals and migrants in first and second grade in 2022. Out of a mixed research of concurrent execution and descriptive scope, we obtained information through database searches, interviews and questionnaires. The research was conducted in Colombia, a unitary Republic, which outlines the national educational guidelines from the Ministry of Education. The results showed that there is a lack of a national policy that provides a flexible education program for nationals and migrants in first and second grade, which affects the enjoyment of the right to education and its dimensions of availability and accessibility. It is necessary to accompany educational institutions to strengthen the dimensions of adaptability and acceptability. It is concluded that the State infringes the rights of those who deserve special protection by excluding them from the educational system.
