- Abstract
The article focuses on the role of state class action lawsuit in resolving wage and hour claims of employees in Kentucky. Topics discussed include decision of Kentucky Court of Appeals in McCann v. Sullivan Univ. Sys. on unpaid overtime, preemption of the U.S. Fair Labor Standard Act (FLSA) over state wage and hour statutes and effect of the Class Action Fairness Act (CAFA) on the possibility of recovering unpaid wages under common law theories of contracts, unjust enrichment, and conversion.
