- Abstract
An essay is presented on the problems related to enforcing environmental constitutional rights during trials. Topics include environmental rights and duties in the constitutions of Montana and Illinois, the public trust doctrine being enforced in court case Robinson Township v. Pennsylvania, economic growth being threatened by environmental rights and environmental rights not being used in courtrooms due to short term elections and political pressure of state judges.
