- Abstract
The article focuses on the U.S. Fraud Enforcement and Recovery Act of 2009 (FERA) which was enacted by the U.S. Congress in the wake of 2008 economic collapse. It mentions the back-and-forth between the U.S. Supreme Court and Congress over the proper scope of liability under the U.S. False Claims Act (FCA). It also mentions the retroactive application of the FERA amendments would violate the Ex Post Facto Clause of the United States Constitution.
