- Abstract
The article explains the concept of dishonesty in commercial crime and provides lawyers what may or may not constitute a dishonest conduct. It defines dishonesty as an intent to defraud and lists down the use of dishonesty in white collar and corporate crimes based on Queensland's Criminal Code 1899 and the Corporations Act 2001, respectively. Tests for dishonesty such as the Peters test and the Ghosh test are described. It mentions cases that depict the different categories of dishonesty such as deception, concealment of facts and willful blindness.
