- Abstract
The article presents an analysis and identifies the limitations of s 32(1) imposition of interpretative obligation in the Charter of Human Rights and Responsibilities Act of 2006 (the Charter Act) of Victoria. Relevant comments of Chief Justice Spigelman on the scopes of s 3(1) corresponding obligation of the Human Rights Act 1998 (the United Kingdom (UK) Act) and the s 32(1) of the Charter Act is presented. Also noted is the indication that the s 32(1) of the Charter Act has a scope that is more narrow than that which is imposed by s 3(1) of the UK Act.
