- Abstract
The article criticizes the informed choice proposal by Margaret Berger and Aaron Twerski, leading scholars in their respective fields of evidence and products liability. It outlines guidelines that would allow plaintiffs claiming injury from pharmaceutical products to recover damages for deprivation of informed choice. It looks at a litigation claiming that Benedectin caused limb reduction and other birth defects from 1970 to 2000. It looks at the possibility of barring the proposal through the preemption doctrine.
