- Abstract
The article discusses a court case that addresses the extent of Court of Federal Claims (CFC) jurisdiction in the Nebraska Public Power District versus the United States(NPPD II). It states that the NPPD II enhances the ability of plaintiffs to forum shop while further diminishing the exclusive jurisdiction of the CFC. It also discusses the Nuclear Waste Policy Act of 1982 that established a series of deadlines for the Department of Energy to complete the intermediate steps toward the construction of a repository, following the dispute in NPPD II.
