- Abstract
The author focuses on the Clean Water Act in the U.S., which is the foundation of federal and state directives for the protection and preservation of water from pollution. The author highlights U.S. Supreme Court cases under Chief Justice John G. Roberts, Jr. in order to examine the Court's treatment of the CWA. He argues that the Court under Roberts ignores the primary goal of the CWA, lacks appreciation of its structure, language, and basic science, and focuses on costs associated with the CWA, among others. Court cases such as Rapanos v. United States, S.D. Warren Co. v. Maine Board of Environmental Protection, and Coeur Alaska, Inc. v. Southeast Alaska Conservation Council are discussed, as are the justices' opinions of the cases.
