- Abstract
The article provides an overview of the nature of the sentencing decision-making process in Australia , and also analyses the negative practical consequences of the instinctive approach to sentencing. Topics discussed include sentencing as a part of the criminal law and comprises the mechanism through which criminal offenders are punished for their crimes, Australian Law Reform Commission's report on drug and fraud offences, and penalties imposed in relation to child sex cases.
