- Abstract
An essay is presented on on the 1905 U.S. Supreme Court case Lochner v. New York, the concepts of federalism, and the U.S. Patient Protection and Affordable Care Act (ACA). It also examines legislation proposed in February 2011 in the South Dakota House of Representatives concerning firearms purchases and its relation to the constitutionalism of a provision of the ACA.
