- Abstract
More than 100.000 lay judges are in Germany currently acting in courts in all five judiciaries. Together with the professional judges the lay judges exercise judicial office in full and with the same voting rights in the decision-making. In the majority of cases the appointment to the office of lay judge follows a voluntary decision of the nominees. Only the selection of lay judges for penal courts with lay judges (Schöffengerichte) is based on the more anonymous procedure of becoming included in a list of nominees compiled by the municipality. Meanwhile, some recent empirical research projects have helped to know more about the motivation of lay judges, about their ways to participate in the hearings and in the decision-making and about their experiences and evaluations. What can be seen from the data and from the interviews is the interest in the judicial activity and the lay judges' impression to be able to contribute to justice, understandability and acceptance of the decisions.
