- Abstract
In a long period of time, the issue of the relationship between national and international laë has been unclear regarding the applicability of criminal legislation. The concept that the area of criminal law is entirely the internal law of the state is abandoned "completely". It was thought that every state "has the absolute right" to regulate the (criminal) legislation without any influence of international (criminal) law. Such a view existed from the concept of the absolute sovereignty it has, but which has in the past faded under the influence of the protection of human rights and freedoms, to the extent that international (criminal) law became an indivisible part of national (criminal) law, both in the sphere of criminal responsibility, the type of criminal offenses, the magnitude of the punishment, up to the "silent imposition" of lex specialis.
