Fourth Amendment Small Claims Court.
- Authors
Myers II, Richard E.
- Abstract
An essay is presented which proposes to create a specialized small claims court to deal with alleged violations under the Fourth Amendment of the U.S. Constitution. This proposal considers proposals concerning the exclusionary rule by Professors Christopher Slobogin and David Harris. According to the author, the proposed small claims court would be created by states or localities as an alternative to the exclusionary remedy. The Supreme Court's position on the exclusionary rule is discussed.
