- Abstract
This article discusses the issue of timeliness of American Insurance Agency company and Travelers Insurance company over the plaintiff's claim of traffic accident involving an uninsured motorist in the U.S. The owner of the vehicle was insured by defendant American. The plaintiff was insured by Travelers. Plaintiff's decedent was killed while a passenger in the owner's car, with which an uninsured motorist collided. Plaintiff's decedent was an insured party under the uninsured motorist coverage provided in the Travelers policy. In the course of the arbitration proceedings, the arbitrator expressed his desire to have the circuit court determine the respective liability of each insurance company. paid by American and that Travelers would be liable for the excess. Thereafter, the arbitrator awarded plaintiff 10,000 dollars from American and 652.08 dollars from Travelers.
