- Abstract
This article presents information regarding the ruling of the case British Overseas Airways Corp. v. International Association of Machinists and Aerospace Workers. When an employee submitted a grievance to arbitration alleging that the company had filed a vacancy from outside and the arbitrator determined that the company could not fill vacancies and directed the employee be promoted, the court vacated that portion of the award directing promotion as being beyond the submission and in excess of the arbitrator's authority.
