BURDEN OF PROOF -- UNINSURED STATUS OF TORTFEASOR -- UNINSURED MOTORIST CLAIM -- STAY OF ARBITRATION -- NEW YORK.
- Abstract
This article focuses on the judicial decision made by the federal court of New York State against the case "Zelanka v. MYAIC, 32 A.D. 2d 847," concerning laws for uninsured motorist insurance claims. It is argued that, although court felt that the "Order of Revocation of Non-Resident Motor Vehicle Privileges," submitted by claimant constituted sufficient proof to establish that the vehicle which allegedly caused the accident was uninsured, it stayed arbitration pending a jury trial during the course of which insurer was to be afforded an opportunity to submit proof, if any, that the automobile involved was insured.
