- Title
The Assignment Clause in First-Party Property Insurance Policies.
- Authors
Colinvaux, Catherine M.; Heres, Kristin Suga
- Abstract
The article discusses the provision of the postloss assignments by the U.S. courts as a property insurance policy. It mentions that the antiassignment clauses would protect the insurers from increased risks due to an assignment of an insurance coverage. It states that the insurers would limit the ability of the insured to assign coverage rights to prevent themselves from any increased risk. However, the insured could not assign unaccrued rights when their right to coverage has not been accrued.
