- Abstract
The article explores how attorneys respond to apologies by defendants in litigation as they advise claimants about settlement and compares their reactions to those of the lay litigants. Discussion on apologies in litigation is presented including results of previous studies that show the effects that result from apologizing. According to the author, attorneys differ from laypeople in how they view the implications of apologies because they tend to set their aspirations higher and expect more in terms of fair settlement when an apology is given.
