- Abstract
Since the amendment of the Portuguese law on civil procedure by Decree-Law 303/2007, if the Court of Appeal confirms the final decision of the First Instance Court, the law prevents the defeated party from appealing to the Supreme Court again. As a result of this amendment, it is likely that the defeated parties start to appeal directly to the Supreme Court (per saltum appeal) more often. However, the successful parties may not be interested in per saltum appeals and, consequently, it is expected that they will try to avoid these appeals with any procedural means available, like for instance by broadening the scope of the appeal, challenging interim decisions or filing counter-appeals.
