- Abstract
The article presents information on legal developments in marketing relative to the regulation of product characteristics. Regarding packaging and labeling, the article discusses U.S. Federal Trade Commission (FTC) action against Verrazzano Trading Corporation and four other firms operating in New York City, which had imported fabric which the administrative law judge concluded was misrepresented and misbranded. The article emphasizes the importance of technical substantiation of product descriptions and claims. In another case involving Steven S. Weiser, regarding labels of imported clothing, the FTC concluded that the foreign manufacturer's name may be used, but must be the actual name of the company doing business. This is ultimately the responsibility of the importing person or firm.
