- Abstract
The article discusses the reversal unanimous judicial precedent of the Supreme Court with regards to its decisions for the two liability provisions of the Superfund statute such as Sections 107 and 113. It mentions the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) or Superfund Law, which is a hazardous substance statute. It states that district courts used the section 107 of the CERCLA such as the district court in Pinal Creek Group V. Newmont Min. Corp.
