- Title
UNITED STATES V. PENA-MONTES: REPLACING OFFICER EXPERIENCE WITH JUDICIAL SCRUTINY IN REASONABLE-SUSPICION ANALYSIS.
- Authors
Stingley, Brett M.
- Abstract
The article presents the comments of the author on the case of U.S. v Pena-Montes, wherein the U.S. Court of Appeals for the Tenth Circuit held that the suspicion of an officer that a dealer plate was stolen does not provide the basis to continue the detention and question of the occupants of the vehicle. In resolving the argument against reasonable suspicion, the court focused solely on the legality of dealer plate use.
