- Abstract
The provisional driving license issued by the United Kingdom of Great Britain is valid only within the territory of that country and, at the same time, it imposes certain restrictions regarding the manner of use on the public roads of the respective country, since it is not acknowledged in other European Union states, including Romania. If the defendant does not own any driving license valid in Romania, but only a provisional driving license issued by the English authorities, we face with the situation governed by Article 335 para. (2) the last assumption of the Criminal Code, respectively „who is not entitled to drive any vehicles in Romania“, since the provisional driving license is not acknowledged by the Convention on Road Traffic, Vienna, 1968, and the respective driving license shall not be valid outside the issuing country.
