- Abstract
The article focuses on the Texas Supreme Court's decision in the case Brookshire Bros. v. Aldridge in which court proposed a new framework for addressing claims of spoliation at trial and new limits in presenting any such evidence to the jury. It mentions the long-standing jurisprudence concerning the jury's ability to hear evidence. It also presents litigants with a number of challenges in seeking appropriate relief for the loss of relevant, material evidence.
