The author comments on the article "Is The Jury Still Out? The Controversy Over the Traditional Rule Requiring a Non-Jury Trial in Maritime Insurance Declaratory Judgment Actions in Federal Court," by Steven E. Goldman and Michael I. Goldman. Such article explores whether a defendant should be allowed to demand a jury trial over a counterclaim for breach of a marine insurance policy in the wake of diversity jurisdiction. The Goldmans argue that the plaintiff's right to assert a non-jury claim allows them to prevent the defendant to demand a trial.
