- Abstract
The article provides a background of the essence test in federal and Pennsylvania law. The case of Slippery Rock University of the Pennsylvania State System of Higher Education versus Association of Pennsylvania State College & University Faculties is discussed, in which the Commonwealth court of Pennsylvania used the essence test to vacate an arbitrator's award to a university professor who was denied tenure.
