- Abstract
The article analyzes that whether search engines, as non-parties, are bound by injunctions against counterfeiters under the Federal Rule of Civil Procedure 65 (Rule 65). It discusses several court decisions on cases including Tory Burch v. Doe, Burberry v. Doe and Hermès v. Doe. It also discusses several methods for binding search engines as non-parties for effective prevention of the unlawful use of trademarks by counterfeiters.
