- Abstract
The article offers information on the use of personal names as trademark rights and as publicity rights. It discusses the partial alienability theory of publicity rights regarding prohibition of the trademark use for assignment of personal names. It analyzes the decision of the U.S. district Court for Southern District of New York in JA Apparel Corp. v. Joseph Abboud regarding transfer of publicity rights along with trademark rights.
