- Abstract
This article analyzes the duration of the investigation in cases attributed to the Delegated European Prosecutor's Office and the constitutionality of Article 42 of the Organic Law of July 1, 2021. It concludes that the differentiated treatment of the investigation period in the Criminal Procedure Law and the Organic Law of July 1, 2021 lacks constitutional justification and violates the principle of equality. Law 2/2020 has established a maximum period of twelve months for judicial investigation, with the possibility of extensions of up to six months. The Supreme Court has interpreted that investigative proceedings carried out outside the established period will be null and void. Additionally, the exclusion of Article 324 of the Criminal Procedure Law in proceedings of the European Prosecutor's Office is mentioned, and the compatibility of the regulation of Article 42 of the Organic Law of July 1, 2021 with the Spanish Constitution is discussed.
