- Abstract
This paper attempts to describe a shift in the Derridian concept of "remainder". The first sense of this notion is outlined from Derrida's treatment of the sign and the inherent iterability that underlies its way of functioning; it is later generalized through analyses of the signature and, consequently, of legal institutions. A general account of this first notion of remainder is given through the concept of the structural intricacy of pretention and pre-tension. The second sense of this notion, however, stems from the containment of this initial structure of remaindering in the relationship between the foundation and the conservation of law; this, in turn, gives way to a problematic that supersedes this structural containment, thus making possible the appearance of a new type of remainder that could be identified as justice. The communication between the two meanings of the notions of remainder is facilitated by an analysis of the first stages of the debate between Derrida and Foucault, and of the traces that it leaves in Derrida's subsequent thinking.
