- Abstract
The article focuses on the concept of legal parenthood and the recognition and validity of various family forms in Canada. It examines the Canadian legal framework on parenthood which is based on the idea of a heterosexual family and ignores the existence of cohabiting spouses and same-sex marriage. According to the author, these forms of family are often covered by legal systems that deny them recognition and force them to fit into the legal structure. It is also inferred that it is outdated to base legal parenthood on the heterosexual family since there exists a disconnection between the laws on parenthood and the social realm. It also suggests a legislative reform which would acknowledge and include several family forms to cater the societal shift in the structure of families.
