- Abstract
The article examines the tension between the freedom of expression and the right of an individual to privacy, particularly, its presence in the conflict between street-photographers and their subjects. Topics discussed include the case Foster v. Svenson in the Supreme Court of New York, historical and legal basis of photography as an art form, and trends or biases of current jurisprudence in determining which between freedom of expression and right to privacy should prevail.
