- Abstract
The article presents information about a court's decision regarding Governor's power to give pardon. The decision has come during the trial of the Robin versus Hayes case in New York. A pardon was granted by an impeached governor. The article 4, section 6 of the United States Constitution provides that in case of the impeachment of the governor, the powers and duties of the office shall devolve upon the lieutenant governor until the disability shall cease, after impeachment. This is a method of procedure in a criminal case against a high official. As the reins of government are transferred to the lieutenant governor, a pardon granted by the governor, while under impeachment, is void.
