The article examines the use of mandatory arbitration agreements in long-term care (LTC) contracts in the U.S. It outlines the history of arbitration in the country and the most common defenses advanced by plaintiffs trying to defeat a motion to compel arbitration as well as the role of the Federal Arbitration Act. It highlights a new approach to ensure that the consent to arbitrate is truly informed.
