- Abstract
The article focuses on the rhetoric and reality of Executive Order 13,422, a provision on regulatory planning and review process of the U.S. government. The author stressed that the provision gives presidents, agency leaders, congressional committees, and the courts the ability to influence implementation of regulatory procedures. It identifies the effect of Executive Order 13,422 on the balance of power between the elected branches. The author added that the regulatory review raises some of the most fundamental issues of separation of powers and democratic accountability.
