- Abstract
The article examines the prior restraint doctrine as applied to scenarios in which police officer deletes an individual's recordings of that officer's conduct while in the public discharge of duty, and discusses the history of the prior restraint doctrine. It reflects on prior restraint within the U.S. jurisprudence and in relation to the First Amendment of the U.S. Constitution. It suggests that destruction of the recording of the police or arrest should be considered unconstitutional.
