- Abstract
The article focuses on a legislative debate on the tort law doctrine of contributory negligence in Canada during the period of 1914-1949. It informs that common law supports a system of market regulation of occupational health and safety in late nineteenth century. It mentions that negligence law in Canada fails to fit in academics so legal scholars and the judiciary damned contributory negligence law because of having complicated and unfair to plaintiffs which barred recovery.
