- Abstract
The article examines the decision of the U.S. Supreme Court in the case Rimini Street v. Oracle on American fee shifting and judicial interpretations. It analyzes how cost-shifting affected copyright litigation pre-Rimini and legislation should address heavy transactional costs remaining and copyright law can better achieve goals. It also mentions Crawford Fitting Co. v. J.T. Gibbons, Inc.'s effect on judicial interpretation of cost-shifting statutes, and fee shifting under the Copyright Act.
