The article discusses the case Tullett Prebon plc and others v. BGC Brokers LP and others, wherein claims related to implied duty of trust and confidence were filed in context of the inter-dealer brokerage industry, where brokers act as intermediaries for banks and other financial institutions. It describes the use of forward contracts in the inter-dealer broker market, to secure the future services of employees who may be tied to their existing employer.
