- Abstract
The article discusses the court case Stolt-Nielsen SA v. AnimalFeeds Int's Corp., wherein the issue surrounds on how businesses approach settling claims in Ohio. The Court of Appeals Second Circuit explains that arbitration panel adopts the principle of manifest disregard doctrine citing parties can not preclude class arbitration when absent from the contract. The court upholds the applicability of the doctrine accordingly and finds that arbitration panel unable to meet the doctrine's standard.
