- Abstract
The issue of raising the hands while going to and rising from ruku, which had been a source of dispute among the scholars since the early periods, was brought up again towards the middle of the 8th/14th century by Qwām al-Dīn Amīr Qātib al-Itkānī, one of the leading Hanafī jurists of the period in the Damascus and Egypt regions. Al-Ītkānī argued that raising the hands while going to and rising from the rukū (bowing and rising from the rukū) would invalidate the prayer and claimed that a Hanafī could not follow a Shāfi'ī imam. The author bases this view on a narration by Makhūl al-Nasafī from Abū Hanīfa, which is included in the commentaries of al-Jami' al-Saghir. The Shāfi'ī jurist Tāqiyy al-Dīn al-Subkī strongly criticised al-Itkānī's view and wrote a treatise containing sixteen narrations on the necessity of raising the hands in prayer. Thereupon, al-Itkānī wrote a work in which he analysed the narrations that Tāqiyy al-Dīn al-Subkī put forward as evidence for the raising of the hands in prayer, one by one in terms of senad and text, and explained why these narrations could not be evidence by giving aqlī (by reasoning) and naqlī (revealed knowledge) explanations. The author claims that the view that raising the hands will invalidate the prayer is the main view of the sect and includes Ibn Mas'ūd's narration that the hands should be raised only during the takbir of iftitah as another basis. The author also pointed to the Hanafī jurisprudence basins and mentioned the names of the leading Hanafī jurists of the region one by one, claiming that no opinion on the permissibility of the prayer if the hands are raised has been transmitted from them. Itkānī also made references to the works of Imam Muhammad and al-Taḥāwī, the leading jurists and muhaddiths of the sect, in order to support his view, and included his evaluations on the narrations that al-Subkī put forward as evidence. In this study, the author's approach to the subject will be discussed and then the critical edition of his treatise will be carried out.
