- Abstract
The article discusses the common law in respect of its practical workings with Scots property law's status as Civilian is relevance in the context of Mixed Legal System. Topics include legal systems recognize the advantages of a form of non-possessory security over a changing class of property akin to a floating charge; and Scots law is offering a cautionary tale regarding the problems of integrating a novel security right into existing laws of property, debt and insolvency.
