- Abstract
The article reports on the problem of malapportionment of Diet seats in Japan which has remained unresolved as of 1990. The author reports on three apportionment statutes undertaken by the Diet to correct the imbalances in the House of Representatives but none in the House of Councillors. The issue of apportionment is presented to be a matter of legislative policy but justiciable and in 1983, the Supreme Court has changed the limit of imbalance to a one to three ratio and the reasonable period for correction to be five years. The author stresses the people's disappointment with the judiciary's continuous avoidance of nullifying an election with the use of circumstance decision. The possible solutions of prospective invalidation and revision of apportionment rules are suggested.
