UPHAM, FRANK K.
- Abstract
The author presents his opinion on the state of Japanese constitutional jurisprudence as written in articles by three Japanese professors in 1990. He questions the relationship between the principle of the Code of Criminal Procedure and the reality of actual police practices. The author applauds the Courts' treatment of the malapportionment issue but wonders about the public-private distinction in Japanese jurisprudence. The concept of individualistic groupism in freedom of expression is agreed upon by the author.
