HENDERSON, DAN FENNO
- Abstract
The author comments on papers written in 1990 by Japanese professors on judicial review, rule of law and constitutional revisionism. The problems of power structure, prior social practices, and thought patterns persisting in Japan's politics are said to contribute to the restrained implementation of judicial review by the Supreme Court. The author stresses that much of Japanese society is controlled by unwritten rules unaffected by the Constitution implying a lesser role for constitutionalism. The idea that the Constitution was imposed is also negated.
