PRIVATE-LAW MODELS FOR OFFICIAL IMMUNITY.
- Authors
Epstein, Richard A.
- Abstract
The author analyzes the impact of the immunity from civil liability of a government official on the application of private and public laws. He explains the link to private law because of the claim for compensation from the alleged damage caused by the plaintiff. He states that the status of the official will allow him to claim immunity through the public law, to escape the liability. He discusses the principles of tort law, the adoption of the rule on liability and the justification of the deviation from the legal procedure.
