- Abstract
The article focuses on the constitutionality of state labeling requirements for genetically engineered (GE) foods in the U.S. and analyzes the First Amendment protection of labels as commercial speech. It highlights the U.S. Court of Appeals for the Second Circuit's decision in International Dairy Foods Ass 'n v. Amestoy regarding labeling requirement and analyzes whether the GE labeling legislation would discriminate the Dormant Commerce Clause.
